1. Introduction

Welcome to The Messy Hub’s website. By accessing or using our website, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully. If you do not agree to these terms, you should not use our website.

2. Definitions

“The Messy Hub,” “we,” “us,” or “our”: Refers to The Messy Hub, the owner and operator of this website.
“User,” “you,” or “your”: Refers to any individual or entity accessing or using our website.
“Services”: Refers to the products, subscriptions, workshops, parties, and services offered by The Messy Hub.

3. Use of Website

Eligibility: You must be at least 18 years old or have parental consent to use this website.

License: We grant you a limited, non-exclusive, and revocable license to access and use our website for personal, non-commercial purposes.

Prohibited Conduct: You agree not to misuse our website, including but not limited to:

- Engaging in any unlawful activity.
- Distributing viruses or harmful code.
- Attempting to hack or disrupt our website or servers.
- Using our website for fraudulent purposes.

4. Products and Services

Descriptions: We strive to ensure that all products and services are described accurately. However, we do not guarantee that descriptions, images, or other content are error-free, complete, or current.

Pricing: All prices listed on our website are in South African Rand (ZAR) and are exclusive of VAT unless otherwise stated. Prices are subject to change without notice.

Orders: By placing an order, you agree to purchase the selected products or services in accordance with these Terms and Conditions. We reserve the right to refuse or cancel any order for any reason, including but not limited to product unavailability or errors in pricing.

5. Workshop Bookings

Minimum Participation Requirements:

- We require a minimum of 6 participants to proceed with a workshop.
- Should the minimum not be reached, the workshop will be postponed or canceled.
- If the workshop is canceled, a refund will be issued within 7 working days.
- You will receive communication 24 – 48 hours prior to the workshop date should it be rescheduled or canceled.

Workshop Cancellations:

- - Should The Messy Hub cancel a workshop due to facilitator illness or unforeseen circumstances, you will be notified, and the workshop will be rescheduled.
  - If we are unable to reschedule the workshop and it is canceled, you will receive a refund for that workshop within 7 working days.
  - Should you (the participant) be unable to attend a workshop, no refund will be issued.

Supervision:

- We require at least 1 parent or guardian to be present for the duration of the workshop to supervise the child.
- The Messy Hub takes no responsibility for injury, loss, or damage during the workshop.

6. Party Bookings

Deposits and Payments:

- For bookings made more than 1 weeks prior to the event date, a 50% deposit is required to secure your booking.
- The balance for your party is due 1 week (7 Days) prior to your party date.
- For bookings made less than 1 weeks prior to the event date, full payment is required to secure your booking.
- If full payment is not received within 24hrs of your party date, the 50% deposit will be forfeited and your party booking will be cancelled.

Cancellations:

- Party cancellations made more than 1 weeks prior to the event date will result in the forfeiture of the 50% deposit.
- Party cancellations made 1 week or less prior to the event date will result in the forfeiture of the full amount paid.

Travel Fee:

- A travel fee will be added to bookings.
- Travel fee calculated based on party location.

7. Payment

Payment Methods: We accept payment via EFT or online payment via PayFast. You agree to provide accurate and complete payment information.

Billing: If your payment method is declined, we may attempt to process the payment again. If the payment is unsuccessful, we may cancel your order, booking, or subscription.

8. Delivery and Shipping

Shipping: We deliver our products within South Africa. Delivery times are estimated and may vary based on your location. We are not responsible for delays caused by third-party carriers.

Risk of Loss: Risk of loss passes to you upon delivery of the products to the carrier.

9. Returns and Refunds

Returns: We accept returns within [Insert Return Period] days of purchase for unused, unopened products in their original packaging. To initiate a return, please contact us at [Insert Contact Information].

Refunds: Refunds will be processed within 7 – 14 Working days of receiving the returned item. Refunds will be issued to the original payment method.

10. Intellectual Property

User Content: If you submit any content to our website, you grant us a non-exclusive, royalty-free, perpetual license to use, modify, and display such content.

11. Limitation of Liability

No Warranties: Our website and services are provided on an “as is” and “as available” basis. We do not warrant that the website will be error-free, secure, or uninterrupted.

Limitation of Liability: To the fullest extent permitted by law, The Messy Hub shall not be liable for any direct, indirect, incidental, or consequential damages arising out of your use of our website, products, or services.
